How-Do has learnt that Alistair Sim, the former managing director and co-founder of Manchester's LOVE, has lost his claim against the agency for unfair dismissal.
How-Do has learnt that Alistair Sim, the former managing director and co-founder of Manchester's LOVE, has lost his claim against the agency for unfair dismissal.

Sim took the firm to an employment tribunal in September claiming unfair dismissal in the wake of his high-profile departure from the helm of LOVE last November.

The dispute arose as Sim claimed that - following on from his conviction for assault - he was given reassurances that his fellow agency directors would find a position for him within LOVE's group of businesses, once the furore surrounding the incident had died down.

They denied any agreement was ever in place and insisted that his full resignation - announced via a statement in the aftermath of the conviction - stood.

Sim, one of the original four founders of the business, then moved on to take a position at fellow Manchester creative agency The Chase.

It is understood that he has never received any financial settlement for his share of the business.

When contacted by How-Do Sim said: “I’m very disappointed in the outcome of the tribunal. 

"While it may be deemed the appropriate verdict according to the letter of the law, I cannot help but think I would never have treated one of my fellow directors or staff in the way I’ve been dealt with.

"Nevertheless, I now have to accept the verdict and move on, and that is exactly what I intend to do.”

A decision was originally expected in the case in October, it is not currently clear why this was delayed.

LOVE has issued this statement with regards to the ruling: 

"LOVE are pleased with the verdict of not guilty for unlawfully dismissing Alistair Sim. The judgement was reached by three independent employment specialists at an industrial tribunal in Manchester.

"During 2009 LOVE have got on with what they do best,  great creative work for globally renowned clients such as Sony Playstation, Umbro and Dr Martens.

"The agency has also quietly got its house in order and as a result have a strong management team and a great bunch of talented people working there.  This diligent team have weathered the wider global climate and come out on top.

"This result gives LOVE a positive kick start to 2010. "

How can he not receive any financial settlement for his share of the business? 
I thought although working at The Chase he was still a shareholder at LOVE and would still continue to get his dividends? 
Can someone explain?

Depends what the company is valued at/profits are confused. If it's nothing he'll get nothing. Maybe it's been shut down and relaunched the next day under a different name? If there's bad blood, and lord knows there is, there's plenty of ways to do this. 
As Sim and Love have both said - time to move on really!

How can the company be valued at nothing? 
It wasn’t too long ago that TBWA were rumoured to be buying LOVE. Surely the partners weren’t going to give it away for free? 
I can’t believe that after 10 years of building a brand, it’s not worth anything. 
I smell a rat.

There is the possibility of a "bad leaver" clause in a shareholders agreement/contract, which would set a value (usually diminished, potentially zero) of the shares that someone owns if they do something that they shouldnt (and the something is set out in the shareholders agreement/contract.

Isn’t this the same as what happened to Chris at Dinosaur last year? 
He ‘mysteriously disappeared’ and didn’t get anything for his shares? 
I thought Paul Carrol would have known better!

Why should they 'find a position for him' he's clearly demonstrated he's not capable of behaving like grown man and promotes a bad representation for any company, let along PR.

The matter of his shares is a seperate thing surely. This is just an unfair dismissal case. His shareholding is yet another battle he may now choose not to bother with. 
 
I think the greed of his co-directors given his hard work over the years is unquestionable though.

I agree with Mr Mouse. Like it or not, he was the embodiment of the agency, and worked tirelessly hard to put Love's name out there. Surely he's entitled to something? There's been a lot of bad blood surrounding this catfight- cutting his financial reward seems a huge insult. 
But...you may be right about the business being worth zero. A lot of design consultancies struggle to break even.

It seems very unjust, if someone has put there heart and soul into a business for over a decade his x colleagues stab him in the back in a pretty dark chapter of his life. Shame on you guys, greed is not so good.
